Cites the details of several sums Theophilus owes Daniel Garrard (one of Theophilus's brothers and his father were named Daniel). As surety, Theophilus conveys the right, title, and interest of a tract of land in Clay County, Kentucky, to Daniel (the land is known as "the saltworks tract"). Also presents Daniel with "the Abner Baker place," crops, farm animals, and slaves (including Andy, Bill, and George) until the debt is paid.
Theophilus Garrard represented Clay County, Kentucky in the State Legislature in 1843, 1844, 1857, and 1860. On 16 September 1861 he was appointed to Colonel of the 7th KY infantry (Union) volunteers in the Civil War. He was promoted to rank of Brigadier General on 29 November 1862. From 4 February 1863 to 19 May 1863, Garrard commanded the 1st brigade, 19th division, 13th corps of the Department of the Tennessee and from 1 August 1863 to 1 April 1864 commanded parts of the Army and Dept of Ohio.
