Proceedings of a Regimental Court Martial convened in pursuance of Special order No 35
The Judge Advocate having read the Order convening this court, asked the prisoner if he objected to any member of the Court to which he answered "no" and the Court being duly sworn the charge & specification against the prisoner being read aloud as follows.
Charge & Specification against private Haywood Sullivan Co C 50th NCI
Charge - absent without leave
Specification - In this that said private H. Sullivan Co "C" 50th NCI did on or about the 6th of May 1863 absent himself from his Co & Reg near Kinston without proper authority and remained absent therefrom until the 20th May 1863 at which time he returned to his Co & Regt near Kinston of his own accord.

W C Runprow Co C 50th NCI a witness on the part of the prosecution being duly sworn - Quest by Judge Advocate State what you know in the case of the prisoner private H/ Sullivan Co C 50th NCI now on trial for absenting himself without leave - ans He left about the 6th of May 1863 and returned of his own accord about the 20th of May 1863. Quest by Court - what do you know of his character as a soldier and how long has he been in service - ans - his character is good & he has been in the service near two months" by court did he take his gun with him - ans "yes" - was he ? off as you know - "no" by Judge Advocate - was the Regt under marching orders - ans "yes" - private ? Yellowstone Co C 50th NCI witness on the part of the defense being duly sworn. Question by accused - Did he take off his gun to take care of it or to defend himself - ans - "I heard him say he took it to take care of it." Quest by Court do you know why he ran away? Ans - I do not I heard him say if he was not better fed he would leave.
Hillard Price Co C 50th NCI a witness on the part of the defence being duly sworn - Question by defence - what do you know in regard to this care - ans - nothing - the evidence on the part of both prosecution and defense being ? the court was cleared for deliberation.
